Like sporting events, good results on the field begin in the training room. This recorded webinar, running a little over 90 minutes, is designed to provide participants (lawyers, clients and mediators) with a negotiation game plan beginning with the set up and moving through the opening, the dialogues, the negotiations and the close. The principles discussed are sufficiently flexible to be applicable to commercial negotiations in general, and more specifically, to those that can occur in the mediation process.
Not everyone who comes into mediation is mentally or emotionally prepared to engage in effective negotiations designed to fully explore the opportunities for resolution. Further, many clients and advocates arrive at mediation without a negotiation plan or strategy. Studies of market users reflect that mediators who come unprepared or who lack skill sets to be pro-active negotiation coaches are not at the top of the list. Similarly, lawyers and clients who arrive without an understanding of their desirable and most likely negotiation outcomes, or a method to achieve them, obtain less favorable outcomes in the mediation.
