Dani Schwartz, a member of the firm's litigation department, is noted for crafting creative strategies and solutions to address challenging legal problems. Mr. Schwartz focuses on complex real estate and business litigation, appeals, and arbitrations, including fraud claims, contract disputes, landlord/tenant and co-op/condo disputes, commercial foreclosures, defending class actions, Yellowstone injunctions, Article 78 proceedings, defending housing discrimination claims, and development and construction matters.

 

Mr. Schwartz brings innovative thinking to every client's situation, and has litigated cutting edge cases and appeals and made new law favorable to his clients. For example, Mr. Schwartz recently obtained a court order directing an adverse state agency to pay his client's attorneys' fees and expenses, believed to be the first decision of its kind. In a recent housing discrimination case, Mr. Schwartz was able to overturn a State Division of Human Rights determination as "purely arbitrary," the first such appellate decision since 1998. In a dispute over distribution of stock proceeds, he obtained an injunction freezing the assets of Virgin Islands-based hedge funds until the funds paid a debt to his client. A skilled negotiator, Mr. Schwartz has also obtained victories for his clients at the settlement table, without the need for lengthy litigation.

 

Mr. Schwartz has lectured at the American Arbitration Association, and been featured in Real Estate Weekly. He practices before the state, federal, and appellate courts in New York, as well as numerous arbitration forums and administrative agencies. He represents property owners and landlords, developers, lenders, financial institutions, credit unions, cooperative and condominium boards and unit owners, and commercial tenants.
