Constructive Decisions Inc.
New York, NY
I have been the Arbitrator in over 100 Arbitrations, and the Mediator in over 75 Mediations since 1993, with cases from $20,000 to over 25 million.
As a businessman and construction professional on the panel, I have an extensive practical understanding of the law, a fresh ear to arguments and a true expert’s knowledge of construction and business disputes. I am extremely facile in Excel and often build spreadsheets to make sense of the complex threads of a dispute.
I understand disputes and the damage they cause business from a businessman’s perspective. I have both theoretical and applied mediation training from my studies at the Program on Negotiation at Harvard and coached mediation training at the Center For Dispute Resolution. I have dug ditches, set steel, balanced books, and participated in disputes from an owner’s perspective, a contractor’s perspective and as an ADR professional.
I have the evaluative experience of a dispute professional with over 175 cases. I bring all these threads of experience to bear on resolving disputes.
I help the parties to understand the issues at hand in an organized fashion, to explore the likely testimony of key witnesses, and then to bargain in
good faith towards a resolution that sometimes includes the ability to maintain ongoing business relationships. My mediations include substantial preparation, but the outcome generally leaves the parties satisfied with the resolution because it is based in the facts and realities of the case.
